1. Acceptance of Terms

These Terms of Service constitute a legally binding agreement between you and Kristen Christy Cares, a Colorado-based professional speaking and training business. By visiting our website, purchasing a service, registering for an event, or enrolling in a program, you agree to these Terms. If you do not agree, do not use our site or services.

2. Services Offered

  • Professional Speaking: Keynote addresses, breakout sessions, and conference presentations for organizations, associations, and corporate events.
  • Corporate and Group Training: Live in-person or virtual resilience, leadership, and professional development workshops.
  • Online Programs and Courses: Self-paced and cohort-based digital learning experiences.
  • Digital Products: Downloadable resources, guides, toolkits, and workbooks.
  • Consulting and Advisory: Custom resilience strategy sessions for organizations and teams.

3. Bookings and Payments

A. Speaking Engagements

All speaking engagements require a signed Speaker Agreement and a non-refundable deposit (typically 50% of the total speaking fee) to secure the date. The remaining balance is due no later than 14 days prior to the event.

B. Training and Workshops

Custom training programs require a signed statement of work or training agreement. Group workshop registrations are processed in full at the time of registration.

C. Online Programs and Digital Products

Payment is due in full at the time of purchase. Installment plans, where available, are subject to the terms presented at checkout. Failure to complete installment payments may result in revocation of program access.

D. Pricing and Taxes

All prices are listed in U.S. dollars. Price changes do not affect confirmed and paid bookings. You are responsible for any applicable taxes.

5. Intellectual Property

All content created and delivered by Kristen Christy Cares, including presentations, training materials, workbooks, frameworks, course content, videos, slides, and scripts, is the exclusive intellectual property of Kristen Christy Cares and is protected under United States and Colorado copyright law.

You may not reproduce, distribute, modify, resell, sublicense, or create derivative works without prior written permission. Recording of any live speaking engagement or training session is prohibited without a signed written release.

Personal use of purchased course materials is permitted for enrolled participants only. Sharing or redistributing content to non-enrolled individuals is strictly prohibited.

6. Acceptable Use

You agree not to:

  • Use our services or content for any unlawful purpose
  • Reproduce, sell, or publicly display our proprietary materials without authorization
  • Engage in harassment, threats, or discriminatory conduct during any session
  • Misrepresent your identity or affiliation when booking services
  • Attempt to gain unauthorized access to our platforms or systems

7. Testimonials and Event Photography

By providing a testimonial, you grant Kristen Christy Cares a royalty-free, non-exclusive license to use your words in marketing materials and on this website. We will never alter the meaning of a testimonial.

Photos and video captured at live events may be used in promotional materials unless you submit a written opt-out request prior to the event.

8. Disclaimer of Warranties

Our services are provided as is and as available without warranties of any kind. See our separate Disclaimer for additional limitations.

9. Limitation of Liability

To the maximum extent permitted by Colorado law, Kristen Christy Cares and its principals, contractors, and agents shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from your use of our services.

Our total liability shall not exceed the total amount paid by you for the specific service giving rise to the claim in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Kristen Christy Cares, its principals, contractors, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys fees, arising from your use of our services or violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado. Disputes shall first be addressed through good-faith negotiation. If unresolved within thirty (30) days, disputes shall be submitted to binding arbitration in Colorado under American Arbitration Association Commercial Arbitration Rules.

12. Severability

If any provision of these Terms is found invalid or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, and all remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms, together with any applicable service agreement or program enrollment terms, constitute the entire agreement between you and Kristen Christy Cares and supersede all prior communications or agreements.

14. Changes to These Terms

We reserve the right to update these Terms at any time. Changes are posted on this page with a revised Last Updated date. Continued use constitutes acceptance.
